20 May 2009 a person under the name of his proprietory business doing the business of printing, laminating and directly despatching to patients of renounced hospital of their medical records on behalf of that hospital.he is in dilema as to whether to charge vat or service tax in his invoice. most likely he is interested in charging vat as it is of lower %, is there is any provision in service tax act to avoid charging service tax for this type of business??????

21 May 2009 You must pay service tax on your services provided by u instead of VAT.

if u are taking paper from supplier & make printing,laminating that u are sending. it is service

if u are purchasing paper yourself & printing,laminating & than u are selling ,it is under vat act.

if you are doing only printing job and the paper is not purchased by you than service tax

else part 3 pf Mr Jiwan Hold good
