i had cleared my ipcc in November 2012(result feb 2013) booth group. i was joined CA firm on 1 march 2013...but the principal is abusive in nature and doing mentally harassment to all the articles .....he is pressured to work 13 hours in a day whether he has work to give me or not and he is not given leave in sunday and also in bcom exams.
now i want transfer but he is denied to give me transfer.
plz advice what should i do???

31 March 2013 Hi

During the first year of article ship, you are free to take transfer without any reasons by filing Form-109 with Institute.

Request for transfer not accompanied by consent of Principal shall not be accepted.

In case of dispute between principal and articled assistant, the matter be settled amicably among the articled assistant and the principal concerned and the Institute shall not interfere in such cases.

31 March 2013 pls sir ...advice me another way bcoz my principal will not give me transfer ..

02 August 2025 I understand your situation — it’s really tough dealing with mental harassment and not getting a transfer. Here’s what you can do if your principal refuses to give you a transfer:

### 1. **Send a written request to your Principal for transfer**

Make sure you send a formal written request (email or letter) asking for the transfer. Keep a copy as proof.

### 2. **File Form 109 with ICAI without Principal's consent (first year only)**

* If you are in **your first year of articleship**, ICAI allows transfer **without the Principal’s consent** by filing Form 109.
* Since you joined on 1 March 2013 and cleared IPCC in November 2012, check if you are still within the 1-year limit.

### 3. **Escalate to ICAI Regional Office**

* If Principal refuses and you cannot get consent, write to the ICAI regional office explaining your mental harassment and refusal for transfer.
* Request them to intervene. Though ICAI normally prefers amicable settlements, they can sometimes help.

### 4. **Keep evidence of harassment**

* Keep records like messages, emails, witness statements to prove harassment in case ICAI asks for evidence.

### 5. **Seek legal advice if needed**

* If harassment is severe, consider consulting a lawyer about labor laws and harassment at workplace.

---

### Summary:

* First year articles: File Form 109 to get transfer without principal consent.
* Beyond first year: Transfer needs Principal's consent, else ICAI may not intervene.
* Write formally, keep proof, escalate to ICAI Regional Office if needed.
* Keep evidence of harassment for backup.

---

If you want, I can help draft the **transfer request letter** or guide you through Form 109 filing. Would you like me to help with that?
