Transfer of properties act

13 January 2014 Plz suggestion me tax liability with reference of case when mother is willing to transfer properties to his only one individual son and there are 3 son........

13 January 2014 there is no capital gain in this case as it does not come under perview of transfer as per sec 49(1) as it is case of inheritance.

with regards to other law NOC from other son needs to be taken else later after mothers death they can challenge the will.

13 January 2014 If other son not agree to give NOC than what can we do?




13 January 2014 As per exsiting law...Indiab Sucession Act if noc is not received from other sons then the son who is getting via will can be chalenged in court as i am facing same case in my family where my father got everything from my granny and other uncles havent given noc...so now u have option to make PROBATE of the will for that u need to appoint suitable lawyer and he will do all the procedure required.
