05 December 2012 Can a mother transfer a residential house to her sons as a gift? Is there any stamp duty payable on the same? what is the applicability of gift tax?

06 December 2012 1. Yes a mother can transfer house property to her son.

2. If the house is to be registered in the name of the son, then stamp duty is applicable.

2. Gift tax has been abolished and no tax is applicable on such transfer.
