06 June 2012 My son is in US since feb 12 working with the co with whom he was working in India.. He has only salary income. He is to file tax return along with domestic income to pay differential tax. My quaries are
1. As federal tax assessment will be after january 13 then will >ITO will accept Tax deductions shown in salaty sheets?
2. What type of US taxes are valid for deduction in India.
3 We are filling ITR II so where uS tax deduction is to be shwn in the form
as they have no TAN no.?

Can I get reply on my - mail address also ?

07 June 2012 Financial year 2011-12. Assuming your son has gone abroad for the first time.... his status under Indian Income Tax is RESIDENT. So Feb and Mar 2012 salary in USA is taxable in India subject to Tax relief. For the financial year 2012 -13 (01/04/2012 to 31/03/2013, your son will NON RESIDENT in India and in that case his salary in USA is not taxable in INDIA. 07 June 2012 Agreed with Amolji. As your son has already spent 182 days in India in FY 11-12, for that year he will be considered as Resident and for next year onward he will be non-resident.
