18 January 2011 Dear all,

Please let me know, what will be total tds and which section will be applicable for the following:

Earlier bill amount = Rs.43,017/- (Leakage repairing & replacement of spares)

current bill amount = Rs.98,000/-( AMC given for AC repair and maintenance).

18 January 2011 if the party is individual or HUF
1 % of (43017 +98000),

in all other cases
2 % of (43017 +98000),

one thing more on Rs.43,017, ealier tds was not deducted. if i deducting now, it would be any problem or not.

18 January 2011 This is under section 194 C

For Individual Payee = 1%
Other than Individual Payee = 2%.

This is no where deductible u/s 194J.

As it does not include any Professional or Technical Services.

18 January 2011 Sanjeev is right, AMC work no way falls under 194J, you can go ahead and deduct TDS on the earlier and current payments in the current bill.

As it is an individual it is only 1%
