TDS on Service Tax

09 January 2010 TDS is to be deducted on service tax or not ?
e.g. Bill Amt. - 20,000
Service Tax - 2,000
Total Amt. - 22,000
What will be amt. to be deducted at source @ 10%.

Is there any notification regarding/ circular regarding same .

09 January 2010 TDS to be deducted on Rs. 22000 because as per sec 198 of the Income Tax Act 1961, TDS is a deemed receipt in the hands of recepient of amount.

09 January 2010 It depends on how you treating with the amount of service tax.if you are taking cenvat credite of service tax it means that expenditure which is going to be debited to the P&L A/c is only Rs 20000.00 and TDS will be deducted on Rs 20000.00 only and if whole amount of bill is to be debited to the P&L A/c then TDs is to be deducted on Rs 22000.00
