12 June 2013 Dear Sir,

I have query regarding TDS on Rent.I have case where one compnay had paid rent net of tds in march 2010 without booking exp and depositing tds now in dec 2012 expense of rent was booked and tds paid with interest
now that owner has rent out his asset in 2012-13 to other company where he received rent for tweleve month deducting tds and it is reflected in 26 AS with first company had booked exp and deducted tds is also reflected in 26 AS.and 26 AS in asset owner account with 13 months rent as first comapany booked exp in dec 2012.Now what should do by Asset owner and First Company

12 June 2013 The asset owner should file Itr for 2012-13 with income of new company only and claim TDS amount for the same.(Ignore the TDS entry 2010 as is is wrongly entered in 2012-13.)

12 June 2013 Can asset owner claim tds amount of March 2010.is there any way for claiming that tds amount.as asset owner is saying it is seen in his 26 AS as income which actully not received by him

12 June 2013 it depend on the ITR already filed in 2010.

if income not shown in that year, then it can be shown not.

but it can cot be possible to skip income and shown only TDS amount in return.
