25 January 2011
Where payments are made to shipping agents of non resident ship owners or charterers, the provisions of section 172 will apply and not section 195 / 194C. Pl refer CBDT Circular 723 dated 19-09-1995 for full details.

I agree with Mr. Warrier. but What will be the position if payment is not made to agents of non-resident ship owner?
