Regarding **TDS applicability on Barcode registration fee paid to GS1 India** (₹57,712), here’s a clear explanation:
---
### 1. Nature of the payment:
* Barcode registration fee paid to GS1 India is basically a **registration or membership fee** for obtaining barcode standards and services. * GS1 India is a **registered society / non-profit organization** authorized for barcode issuance.
---
### 2. Is TDS applicable on Barcode registration fees?
* Typically, **TDS is applicable on payments made for services under Section 194J (Professional fees/technical services)** or Section 194C (Contract payments). * However, **if the payment is purely a registration or membership fee**, it is generally considered a **non-taxable fee or a fee for right to use service**, not a professional or contractual service fee. * **If GS1 India provides any ongoing service (like support or renewal service), TDS under Section 194J might apply on such service portion, but not on one-time registration fees.**
---
### 3. Is GS1 India eligible for exemption?
* GS1 India is often treated as a **government authority or a notified body**, and certain payments to government authorities are exempt from TDS. * However, GS1 India is a **registered society**, not a government department. * Therefore, **TDS is applicable only if the payment is for services** (like consultancy, professional fees), not for pure registration fees.
* On a **one-time barcode registration fee to GS1 India**, **TDS is generally NOT applicable** as it’s not a payment for services but for registration/membership. * If you pay any **annual or renewal fees involving service support**, you may deduct TDS under Section 194J. * To be safe, confirm with GS1 India whether TDS certificates are issued or if they have any exemption certificate.

If you want, I can help draft a TDS clause or write an email to GS1 India for clarification on TDS applicability. Would you like that?
