22 August 2011 Dear Expert,

My wife is a Magistrate. For AY 2010-11 & 2011-12 we filed IT return. In both the years TDS has been deducted by Govt.
We have received Form 16 also.

But IT Dept issued intimation u/s 143(1) regarding payment of tax. Although Same amount has been deducted from salary.

We contact in District Court. But as u know no one is aware of TDS returns.

We check our status on NSDL website. No Tax credit is given.

What to do? plz guide. TDS amount is huge.

22 August 2011 If an ordinary man does not know the law, even then it becomes applicable to him.

Here... in the Court of Law , there is no awareness about the TDS matters and the aggrieved party is the Magistrate herself.

You have to contact the person , accountant or clerk, maintaining salary sheets etc. You have to find out, the person responsible who has signed on Form 16 and request him to give the acknowledgement no. of e-TDS return filed, in case he claims that TDS have been deposited. .

In case you are having Form 16, check the correctness of PAN and the TDS amount.

Submit Xerox Copy of the same with the ITO, and in case demands original produce the same also, if he seems to be interested in giving credit of the same.
I know that the chances of getting credit in this way are minimum.
