30 May 2009 hello freinds,

no of times i asked a querry, but did not get proper reply.

querry is:

can we issue tds certificate without deposit of tds.

is it mandatory to furnish bsr code, challan no. & dt of deposit etc.,

our tds is still pending to deposit, in this case can we issue tds certificate on due time

30 May 2009 Ans; of the querry is in yes & no only,

It is not clarified.

if i issue a tds certificate with in time limit, how i can fill the data ie bsr code, challan no., dt of deposit, whereas i hv not deposit the tds .

dt of issue the tds certificate will be late then.

30 May 2009 No you can not issue a TDS certificate till the time you have not deposited the TDS with the government. The data required on the TDS certificare is mandatory and any TDS certificate issued without that data will be null and void and this will be treated a malafied intension also on your part to keep the TDS, a statutory liability, an you may be even prosecuated u/s 276B. Please do not issue TDS without tax deposited
