Reg: Your Valued Advice on taxability of Salary earned outside India and filing of IT Return
Dear Sir,
I had stayed in Lagos, Nigeria for 190 days during financial year 2011-12 i.e. from April 2011 to March 2012 and earned Salary in USD from a Ltd Company at Lagos and same was remitted directly from Lagos to my NRE account at Punjab National Bank, Nagpur besides getting reimbursements for local living expenses in local currency in Naira.
Kindly advise:
1. Whether my income earned in USD at Lagos and remitted to NRE account directly in India is taxable
2. Whether I am required to file the Income Tax return before 31st July 2012?

ans1: No. Your status would be not ordinarily resident.. (with the assumption that you have gone outside India for the first time. Ans 2: Your quantum of Indian Income will decide the date of filing return.

You were not resident in india during the Financial Year 2011-12 and salary earned outside India Hence is not taxable in india.
You are not required to file ITR in india in this case
