For **filing Income Tax Return (ITR) for FY 2009-10 (AY 2010-11)** after the due date, here’s what you need to know:
---
### 1. **Normal Due Date & Late Filing**
* The usual due date for FY 2009-10 was **31st July 2010**. * Since this date has long passed, you cannot file a **regular (on-time) return** now. * You can file a **belated return** under **Section 139(4)** but only within **one year from the end of the assessment year** (i.e., by 31 March 2012 for AY 2010-11). * Since this period is over, you **cannot file a belated return now under Section 139(4)**.
---
### 2. **Filing Return After Due Date / Department Notice**
* Since you have received a **notice for non-filing**, you have the option to file your return **after seeking permission from the Income Tax Department**. * This permission is granted by the **Commissioner of Income Tax (CIT) under Section 119(2)(b)**. * This is usually allowed if you want to file for claiming a refund or for compliance after receiving a notice.
---
### 3. **Action Steps**
* **File an application to CIT requesting permission to file return for AY 2010-11 under Section 119(2)(b).** * Once permission is granted, you can file your return for that year. * You can file the return either offline or through e-filing (if portal supports that AY). * If permission is denied, you may have to face penalty or further proceedings.
---
### 4. **Summary**
| Point | Information | | --------------------------------- | ---------------------------------------------------------------------- | | Section to file late return | Section 139(4) (Belated return) — Not available now (deadline expired) | | Permission to file after deadline | Section 119(2)(b) (CIT’s discretion) | | E-filing for old AY | Possible if CIT permits, otherwise offline mode preferred |
