What is the status of Director(Indian Person) appointed by Japanese holding company on its Indian Subsidiary, where half of the salary bear by Indian and half by Holding Company? Whether the Payment of Gratuity Act is applicable to him?

Actually he is been appointed by Japanese co so I confuse whether he is under employment of Japan and just on Board of Indian co. to complete assign task. Because his employment status will decide about applicability of Gratuity.

He is appointed in Indian Company and he is resides in India and is an India director then he will be treated as Indian director nominated by Japanese company.
