21 December 2010 my client has not started business activity but he got registration certificate voluntarily and he wants to close down his bussiness and surrender the certificate whether he has to file ST-3 if yes then he has to pay penalty of Rs. 2000/-?
pls help.....

EVEN THERE WAS NO BUSINESS DURING THE PERIOD ASSESSEE WILL HAVE TO FILE "NIL" RETURN AS LONG AS REGISTRATION CERTIFICATE IS VALID-- PARA 4.8 OF FAX RELEASED BY CBEC IN NOVEMBER-2007(12STT1)ST

AS PER SECTION 70(1)wef 11.05.2007 make provision for late filing with late feewhich can be up to rs. 2000.00

late fee payble as follows:-
delay up to:-
15 days---------- Rs.500.00
beyond 15days up to 30days ----Rs. 1000.00
DAY OF DELAY BEYOND 30 DAYS ----RS. 1000+100 RS. PER DAY OF DELAY BEYOND 30DAYS FROM 31 DAYS MAXIMUM ------RS. 2000(RULE 7C)
