Shifting of RCM liability

whether we can shift RCM liability to service provider by entering into agreement? In earlier Regime it was valid as upheld in the case of Raatri ya ispat nigam

RCM liability arises in two situations; 1 notified by govt 2 URD purchase.so here you cannot shift your liability
