if i have a opening stock of a script and have done intraday on the same script than the gain is short term gain or speculation under income tax i.e whether should i take short term considering the opening stock i.e follow fifo or should i take it as intraday as per contract note.

As the original shares have not been touched upon, the income will be treated as speculation business income in cases where no delivery has been taken or given.
