22 October 2012 One of my party has has done work for providing and fixing Metal Stand at site of Rs.15,00,000/- in FY 10-11.

They have not raised separate invoice for job work and material.
They have collected 15% VAT on 15 lacs.

Now department says that they are liable for service tax

please give some advise ..........

22 October 2012 The work order will play a crucial role under such circumstances. See if you can take a stand that you have subcontracted the FIXATION work to some body....

23 October 2012 in work order they have mentioned that "providing and fixing metal stand Rs.15,00,000/- + VAT ",

actually we subcontracted work of fixation to labors and we have all invoices of 10 different labors, total and amount of those invoices is Rs.4,25,000/-

23 October 2012 Then it will be very difficult to convince the Service Tax officer.They will try to go by "erection and commissioning of contract"
