service tax on servicing of two wheeler ??? Urgent

26 November 2010 One of my client is a AUTHORISED dealer in two wheeler and also collects service charges on servicing of two wheelers , whether he is liable for service tax.


Whether he can claim basic exempyion limit if he is the AUTHORISED DEALER , in this case the question arises whether he is using the BRAND NAME of any other person.please help whether he is using the brand name of company if he is dealer of Yamaha motors ltd.

26 November 2010 Yes has to pay Service tax on the labour protion of Srvice if you have extended the basic exemption limit.

30 November 2010 Thank you, but the department is demanding the tax and the client is paying service tax even though it does not cross basic exemption limit , now what to do.
