If the same is towards liquidated damages then it could be exlcuded. However examine whethe rthe residential construction is for personal use or not.

Here’s a clear take on your question about **service tax on residential building construction and compensation for delay**:
---
### Background:
* You’re charging service tax @ 10.30% on **25% of the value** of the building (which is the typical abatement for residential construction service). * Now, you have to pay **compensation/penalty** due to project delay.
---
### Key points:
1. **Is the compensation paid by you to someone else included in the taxable value?**
* **No**, if the amount is a **liquidated damages or penalty** paid to the buyer or third party, **it should not be included** in the value of the construction service for service tax purposes. * This is because such compensation is a **separate legal liability** and not part of the service consideration for the construction service.
2. **If you receive compensation from someone else, is that taxable?**
* If you receive any compensation related to construction service, then it would normally be included in the service value and subject to service tax.
3. **Make sure to clearly identify whether the amount is penalty/compensation or a part of contract value.**
---
### Summary:
* The **penalty/compensation you pay** due to project delay is **excluded** from the value on which service tax is charged. * Service tax will be charged on the **contractual value of the construction service** (less abatement), **excluding penalty/compensation paid** by you.

If your project is large (300 acres, multiple residential complexes), ensure proper documentation to support exclusion of penalties from taxable value, in case of audit or query from the department.

If you want, I can help draft a note or documentation format to justify this for your records. Would that help?
