05 January 2013 We are in the manufacturing of automobile components. We have given our factory Building on Rent @ 1.5 L per month.

whether service tax on Rent on factory Building is applicable? If yes, then from when it is applicable.

06 January 2013 Dear Sachin,

The Renting Services are taxable from 01-07-2010 and the levy of tax on the renting is upheld by the Delhi High Court in the case of Home Solution Retails(India)Ltd V/s union of India(2011)33 STT 95.
From 01-07-2012 the same has been included in the declared Services to avoid any kind of dispute.
