Service tax applicability or not for get the commission

21 September 2015 Dear sir,

I have to refer to the customer in hotel for room booking
They give 10% room rent commission it a agreement.

They need bill can i raise the bill with service tax or without service tax

Kindly help me

21 September 2015 u have to charge service tax if the value in year exceeds Rs 10 lacks

21 September 2015 Raise service tax bill only if you are sure that they will pay. This is risk. After rising bill if they dont pay you, you still have to pay service tax.

21 September 2015 Sir.. one more query..

The Hotel Collected the all tax form the customer to paid in Service tax department.

why should hotel pay to the commission person with service tax.

only reference person right..

21 September 2015 whatever service tax they are paying in your bills, they will get deduction in form of CENVAT

21 September 2015 If They not paid, i paid my money shall i get deduction from CENVAT..
