Service Tax and VAT on Software

We are a software company and selling a off shelf software which is developed by us,in this case shall we liable to charge service tax and vat on the same software.

Unfortunately the practical solution to avoid disputes is YES. However the imposition of ST on the transfer of property considering the same as a deemed service is not proper and has been challenged but clear decision not aavilable.
