12 September 2015 As per section 245 refund could get adjusted or delayed against outstanding tax demand even if demand is incorrect and not actioned by local AO after due response from taxpayer
What to do if local AO takes own sweet will time even more than a year even after umpteen visit to IT office

12 September 2015 You may contact AO one final time with written last reminder and if he does not act you should file an online complaint cum grievance on Govt of India pg portal. You may also file a written complaint cum grievance with all documents to Commissioner of Income Tax of your jurisdiction.

18 September 2015 Then do not do anything and sit ideally. If you are not aware of your rights and do not want to do anything than how can you expect income tax authorities to be fair to you.
