Section 194j

This query is : Resolved

14 August 2013 If payment for professional services is made in kind then TDS is required to be deducted or not?

14 August 2013 1. As per Section 194J, TDS is to be deducted at the time of credit or payment, whichever is earlier. So you are required to deduct TDS as soon as the bill is booked.

2. There is no requirement in Section 194J that payment must be made in money only. Settlement of liability in any manner amounts to payment.

Accordingly TDS is required to be deducted even if payment is made in kind.
