15 December 2009 Can an unlisted company pass a resolution by postal ballot? please substantiate your reply by quoting Section or case law. Reply as soon as possible.

15 December 2009 No, The Companies (Passing of the Resolution by Postal Ballot) Rules, 2001 - Rule 3 says "These rules shall be applicable to listed companies and in case of resolutions relating to such business as are specified in rule 4."

Hence for unlisted companies, these rules are not applicable.
