10 November 2010 Would any person winning the prize in KBC be subject to TDS u/s 194B. Also please let me know that when the celbrities win the prizes & donate the entire proceeds to charitable institutions would they still be liable to TDs u/s 194B since the are the initial recepients of the winnings. Please clarify.

1. Prize won at KBC is liable for TDS.

2. Prize won by Celebrity for charitable institutions is liable for TDS but the deductee is charitable institution itself and not the celebrity.

10 November 2010 in my opinion Yes TDS wil be applicable.
Because:
giving charity is an application of income and the person is wons the amounth so it is taxable in his handsonly and not in the hands of Institutions.
and again the same will be treated as donation in the hands of Society

Giving charties may comes deduction u/s 80G.
