20 May 2011 whether for counting 2/3 of total director for the purpose of sec: 255(1)director appointed u/s 408 (by CG) will be counted or not ?

21 May 2011 As per section 408 central government is authorized to appoint Director in a company, the director such appointed are not counted for sec 255(1)and not subject to retire, they are appointed for 3 years subject to removed by the central government.

22 May 2011 My another question is whether for counting of total strength u/s 255 director appointed u/s 408 shall be counted. If not why?
(as like addl director u/s 260 is not counted for total strength as sec260 overrides 255)

22 September 2011 Appointment done by the Central Government is not counted and it can be removed only by the central government.
