Reverse service charge on advocate bill

25 June 2014 Sir,

Please reply of my query that we are pvt Ltd Co. and has received a Bill from an Individual of Advocate Firm of Rs. 30000/- on 31.5.14 and our Pvt. Ltd. Company turnover in the previous year 2013-14 was nil and company is not registered with Service Tax Deptt.

Whether our Pvt. Ltd. Company is liable to Pay Service tax under reverse charge.

I shall highly be appreciated for utmost reply.....

25 June 2014 yes yes yes......please reg. immediately under ST . and pay Service Tax under reverse charge. Private Co. are liable to pay ST.

25 June 2014 Reverse charge wiil applicable on advocate service @ 12.36% will pay by company under legal services.
company have to register under the service tax and take service which you receive the services.

26 June 2014 Thanks for your prompt reply to Mr. Devan & Mr. Rupesh Jain. Sir, i have read that if the Receiver of the services , Turnover / Services provided total amount is less that Rs. Ten Lakhs in last /previous year than Service Tax not to pay under Reverse Charge on legal services provided by the Individual or firm of Advocate.

27 June 2014 ST under Reverse charge is payable from Rupee 1. no Exemption of Rs. 10 Lacs in this case.
