can any body tell me, if a company pay more than Rs 10 lacs to a unregistered person as commission on sell of land and that service provider is an unregistered person not charging any service tax then what is the liability of the company???

22 July 2013 if payment to unreg per is made for more then rs10 lacs such unreg person needs to get himself reg and pay service tax.

co. do not have any liability if reverse charge is not applicable.

But If that unregistered person dont want to be registered, is there any liability with the company?

22 July 2013 such unreg person is forcefully aser law under finance act,1994- service tax needs to get registered else int and penalty will be imposed if dept comes to know abt it.
