CAN BE FILE THE RETURN FOR A/Y 2012-13(SALARY) IN JAN 2012. FORM 16 IS THERE FOR 9 MONTHS.

No. You can not. You can only file after the end of financial year. i.e. after 31.03.2012. Above all the forms are not notified even after 31.03.2012. Untill the forms are notified by Income Tax Deptt you can not file your Income Tax Return.

A salaried employee can file return for AY 2012-13 in pursuance to Section 174 only.
