07 January 2012 CAN BE FILE THE RETURN FOR A/Y 2012-13(SALARY) IN JAN 2012. FORM 16 IS THERE FOR 9 MONTHS.

07 January 2012 No. You can not. You can only file after the end of financial year. i.e. after 31.03.2012. Above all the forms are not notified even after 31.03.2012. Untill the forms are notified by Income Tax Deptt you can not file your Income Tax Return.

07 January 2012 A salaried employee can file return for AY 2012-13 in pursuance to Section 174 only.

- If he is going out of India and has no intention to return back.
.
If he is here only, he may file his return not earlier than '04-2012'.
