please guide if a travel agent who has service tax no. and have not income more than Rs. 1000000/- Is he bond to charge service tax in his bill and to file service tax return Or he can maintain the books and charge service tax when its income cross the limit of Rs.1000000/- As he is not sure that he will earn Rs. 1000000/- this financial year.

21 June 2014 If he is registered with Service Tax then he must collect Tax and pay to govt. If the liability is not crossing the limit then u have to file a NIL return.

he do not want to surrender his registration number and some CA has advice him to not to charge the service tax until its income cross the limit of Rs. 1000000/-
In that case if he not collect the service tax and do not file return then what penalty will be charge on him?

21 June 2014 I M not saying to collect Tax, even the limit doesn't crosses. But u must have to file a NIL return. And if u do not wana file nil return also then u must have to cancel ur RC.
