retail invoice/tax invoice

06 March 2011 Dear Sir,
by mistake, We have issued tax invoice in case of interstate sale. now on check post our truck has been detained by check post authority. all other formalities are as per law. kindly let me know what are the consequances of this mistake.

Truck will be released after paying the penalty. In many cases Truck may detained at check post either at the time of entering or go out of state for various reasons. Viz. Non filling of Timely Returns, Failure to produce the required forms on the check post as per the requirement of the state, issuance of tax invoice in place of retail invoice. Sometimes reasonable opportunity being given to assessee to heard. In your case its happened because of mistake without any intention to mislead to Sales Tax Department. They release the Truck by charging minimum penalty amount, which you will have to pay on Check post. No major consequences will be taken place as it is not a crime.
