26 November 2013 I have a hotel and i have given it to a comoany t run the hotel and the consideration i will get is 20% of gross reciepts.
Now is service tax applicable on can it be called rent.

26 November 2013 yes its rent calculated on revenue basis.

if your rent exceed 10 Lac per annam , then service tax will apply

27 November 2013 The method of calculation can be differ but its rent by nature.

also you TDS should has been deducted u/s 194I
