I would like to know, one of my client has a representative office in India and has applied to RBI/CG for the licence to start the business in India.
Now they have got the licence to start the business in India and they have to inform the ROC within 30 days about the receipt of the permission and new place of business in India.
So, can you please let me know, which forms to be filed, i.e. FC-1 or 2.

For a foreign company having a representative office in India, once it obtains permission/license from the RBI or concerned authority to start business operations (like converting from a rep office to branch or project office or setting up a place of business), it is mandatory to inform the ROC within 30 days of receiving such permission.
Which e-form to file with ROC? Form FC-2: This form is used for intimating the alteration of the documents filed for registration of the foreign company, including change in the place of business or commencement of business in India. Form FC-1: This is generally the form for the initial registration of the foreign company with ROC (like when the representative office was first registered). Your case: Since the representative office is already registered with ROC (FC-1 already filed), and now the foreign company has obtained permission/license to start business (i.e., commencement of business), the correct form to file is: Form FC-2
