Registration in same premises & persons but another name

21 November 2013 We are running a firm registered under service tax. Now we are registering a company with same partners as directors in the same premises with name addition of INDIA PRIVATE LIMITED.
1. Our division superintendent asked us the reason for creation a another company with same persons. whether for aviation of service tax.
2. whether we can register and claim exemption limit.
3. If there are any notifications or circular on registration with same persons kindly mention it.

22 November 2013 1. you can register an additional company.

2. you can show that the objective of both the entities is different and hence the same could not have been done in a same business. just for eg: A CA firm and a management consultancy company by same chartered accountants can be registered in same premise and have to necessarily have two entities as you cannot to management consultancy in a CA firm

3. so its a matter of fact that you need to demonstrate.
