Reg society formation charges

04 December 2012 Hi...

I have purchased flat from builder in Jun.2011 and taken possession in Feb.2012. I have paid all dues as per agreement. Now suddenly builder raised outstanding demand that there is service tax liability pending on society formation charges.

Just wanted to know is it applicable and if yes at what rate...?

Please provide me notification if any...

Awaiting expert's opinion.

04 December 2012 As per My View.,U can deny the service tax liability., as it was not mentioned in the agreement ., and also., the liability to pay the service tax is of the builder and not you., and u had cleared all the dues.
