13 February 2009 My client is proprietor and doing cement trading and earn commission from company.

He was registered him self as BAS category service tax receipiant in Jan 2005.

His turnover never cross for pay service tax pay hence, he was not collect service tax nor pay service tax and service tax return. Now he want to surrender his STR Certificate but ST Inspector say he must filed ST return along with panaly.

Now what i can do?

13 February 2009 In such situations the service provider has to file all the pending 1/2 yearly NIL returns. Late filing fee ranging from Rs.500/- to Rs 2000/-, depending on the period of delay, has also to be paid. Then only the surrender application will be considered by the department.
