refund of tds under section 195

plz solve my query
fact of case
actually we (company) have deposited tds u/s 195 by doing grossingup income of foreign company for service rendered by that company i.e we have to bear tax component.now as per high court judjement such service is not taxable.now can we get the refund of paid tds to government on the basis of high court judgement? if yes, which provision will be follow?

You will get refund by filing the TDS return or by claiming refund u/s 237.
