Refund of TCS deposited on purchase of immovable residential property

This query is : Resolved

Quick Summary
If you've deposited Tax Collected at Source (TCS) on purchasing immovable residential property, you generally cannot claim a refund for it. The TCS is typically claimed by the seller of the property in their Income Tax Return (ITR), not the buyer who made the deposit. You would have likely deducted Tax Deducted at Source (TDS) on the payment to the seller, and that TDS is what the seller can claim.

12 June 2025 I have deposited TCS against purchase of a residential property. Can I claim refund of that deposit while filing my ITR?

If Yes, where should I show that deposited TCS? "Advance Tax"?

12 June 2025 You would have deducted TDS of 1% over the payment given to Seller of the property. Only seller can claim the TDS in his/her ITR; not the purchase who deposited the TDS.

27 September 2025 Good luck..
