29 March 2012 My clients daughter was minor for A.Y 2010-11 so her interest income was merged with my clients income. but by mistake S. A.Tax was paid on clients daughter name. My client had got a notice from IT dept some months later to pay tax which was due as she had already paid same tax on her daughters name. On getting notice she paid same amount of tax on her name. Now i need your help as how i can get refund of tax paid on clients daughters name as now double tax have been paid.

29 March 2012 You can file application with income tax department for refund of tax erroneously paid alternatively you can file nil incometax return of your client's daughter and claim refund in it.

do i need to file application on my clients name? and could you help me with the format of application to be given to IT dept and what i need to attach with application.
Secondly, clients daughter was minor in the year in which tax was paid on her name so can i file return for AY 2010-11 of clients daughter and claim refund in it as no return was filed of her for A. Y. 2010-11

30 March 2012 You have to claim refund in your client's name in Form No.30 which can be downloaded from IT dept.website.

However it's better to claim refund by filing return of minor in form ITR-2.which can also be e-filed through internet.

Remember in both case last date is 31st March,2012
