Refund of Service Tax paid

04 September 2008 Hi,
We are 100% EOU, exporting Agri products.
We are paying service tax to logistics(Transportation of goods from Bangalore to Chennai).
we are not liable to any customs duty.
We are not utilizing the service tax paid as cenvat.

Query :

Is there any possibility that we can get the refund from the service tax department.
If it is so..under what section..
Kindly resolve my query ASAP...

06 September 2008 Yes , you can apply for cenvat credit of service tax paid being EOU

Please refer rule 5 of Cenvat Credit Rules 2004 and apply in form A .
