Recovery of tax when matter under appeal

20 November 2015 Hello Experts,

Is it mandatory to pay full income tax demand plus intt raised for AY 2011-12 by IT department when the case is put under CIT(Appeals).

The IT department is compelling us to fully pay the Income Tax Rs.1.52 crores plus Interests Rs.0.54 crores however in 10 instalments.We are going for appeals and we may rush up to High court/Supreme Court as well.

Is it mandatory to pay full tax plus interests at any stage from CIT(Appeals) to Supreme Court appeals?

For AY 2012-13 the same kind additions they have made again demanding taxes. We have financial hardship. So please reply as early as possible.

If we need to pay tax, how much percentage is mandatory for us with interest or without interest?

25 November 2015 It is not mandatory to pay entire demand before appeal. If you are not happy with the decision to make payment in 10 installments and facing financial hardship you may consider writ petition before the jurisdictional high court for stay of demand.
