Hi,
What is bonus Vs Ex gratia.
Whether can i pay bonus at the rate of 16% when there is no allocable surplus i.e. 8.33% alone was required to be paid.whether can i call it exgratia.

I think you have not understood the question my question is if u pay whether u call such excess payment as bonus or exgratia????

Ex Gratia is not mandatory. Ex-Gratia is given to non-factory employees & to whom payment of bonus act in not applicable.

my question would be made very clear ( i know what does exgratia mean) my question is bonus paid over and above the compulsion by law is whether a bonus or exgratia(ex: im in nil allocable surplus and i pay 20% bonus 8.33% is compelled by law whether the remaining 12.67% is exgratia or bonus)
p let me know about the set off calculation for this case
