Process of being terminated from firm on denial of principal

21 August 2014 I have completed my articleship period recently but my C.A(Principal) is not ready to sign the form 108 and standing on his commitment. In this case what can be my action of being terminated except the option of mutual understanding with principal.Because its getting impossible.

And what about form 119 is it valid now. If it is valid then how can i serve it to the CA.

Plz its urgent help me to get better solution .

21 August 2014 i think you are confusing between termination and completion of articleship.

Signing Form 108 is not a mutual decision but a compulsory requirement.

If your principal refuse, sign form 119 and send a copy to ICAI and your principal. If the principal doesn't sign the form 108 in 15 days, Form 119 shall become final as service certificate and Form 108 will no more be required.

If I submit form 119 then when will I be able to join the next firm in case of excess leave.Is there any time criteria.

And other problem is that i have to appear in exam this November,14. How can i handle these problems.

Form 119 will be sufficient for me to get transfer to other firm to serve excess period of leave.

21 August 2014 first of all, have you completed 3 years or not. If you have, then yes, you can join another firm to serve excess period.

If you haven't completed three years, you cannot file form 119.

Yes I have. Can I join the firm as soon as I submit the form 119 to the principal or have to wait for the action from the Principal or wait for the certain time period lapse.

And what about my exam.Can I appear in this November,14 CA final exam with signature of C.A other than my Principal after submitting form 119.
