Principal claiming refund for excess stipend paid

28 September 2015 I am in the first year of articleship and had requested for transfer 2 months ago.Initially my principal refused but now he is ready to sign Form 109 under the condition that I repay him the excess stipend received as compared to the Institute's guidelines.

I have worked on an average for 48 hours per week which is in excess of the stipulated 35 hours as prescribed by the Institute.

Is the principal allowed to claim excess stipend paid inspite of making me work for more than 35 hours per week?

29 September 2015 he is not allowed to do so.. but for giving you transfer he is demanding the same in cash in mah view....
