Service tax payable for the half year is Rs.7500/-. Return filed belated by 180 days. Is the penalty is Rs.16000/- or Rs.7500/-. (Tax is lower than penalty)?

Late filing fee is Rs. 16,000 because waiver/ reduction ,though discretionary, applies for a case wherein the GROSS amount of service tax payable is NIL.
