Please clarify whether we can allow HRA claimed by an employee Rs.50,000/- per month on simple declaration to his spouse or any document is required to be taken to safe gaurd Company interest as it is responsiblity of the company to answer at a later date.

In my opinion, as well as supported by others too, rent paid to spouce can not be claimed in HRA, as it is presumed that husband and wife do not live separately in normal conditions. It is very tough to prove in litigations. If you want I can send you an article too on this matter highlighting this view. This article was published in a business news paper.
