Quick Summary

A proprietorship firm cannot legally own property in its own name. While the Supreme Court has discussed property ownership extensively, there are no rulings supporting registration of property under a sole proprietorship. While several Supreme Court judgments discuss property ownership and title, there are no reported Supreme Court decisions upholding property being registered in the name of a proprietorship firm as valid. In fact, they reinforce that property must be held in the name of an entity recognized by law, and a sole proprietorship is not such an entity.
